To further improve your user experience, our company will collect necessary data during service with the intent of providing you more intelligent and practical services moving forward. When you use this service, the collection, processing, and related utilization of personal information involved are protected by this Privacy Policy. Based on the protection and respect of personal rights and interests, the collection, processing, and use of personal information by this service will be conducted in good faith and in a trustworthy manner. Unless there are special provisions stipulated by law, it will not exceed the necessary scope for the specific purpose and will remain consistent with the legitimate and reasonable purpose of collection.

This Privacy Policy only applies to this service and the personal information that is entrusted or involved in the collection, processing, and utilization of this service. The provisions of this Private Policy do not apply to the personal information provided through links related to this service but not entrusted by or managed by the service. 

If you refuse to provide the necessary information required for this service, you may not be able to enjoy the full service or be completely unable to use the service.

II. Notice of Collection, Processing, and Use of Personal Information

To ensure the protection of personal information and privacy rights, our company would like to inform you of the following matters in accordance with Article 9 of the Personal Data Protection Act:

• The "gMOT Cloud" APP will access the corresponding information in your mobile device according to the functions you use, including:

  • Camera (for scanning QR codes, capturing portraits, capturing motion in sports)

  • Photos (uploading portraits)

  • Mobile device information (including Mobile Network Code (MNC) and Mobile Country Code (MCC) for mobile identity verification)

  • GPS (to obtain your coordinates)

  • Phone

  • Mobile data and network

  • Siri and search (for using functionalities like Siri to assist)

  • Notifications (including push notifications)

  • Document storage (choice of storage location)

• To provide a comprehensive and proactive health management, the "gMOT Cloud" APP will collect health information after obtaining your consent, including:

  • Height

  • Weight

  • Walking

  • Distance (walking + running)

  • Speed

  • Energy expenditure (dynamic calorie count)

  • Physical activity (collecting data on walking and running, gait, foot pressure, etc.)

• Period, region, object, and method of use of personal information:

  • Period: Registration period for the company’s APP.

  • Region: Personal information will be used in Taiwan and the regions where our company's servers, backup servers, and cloud servers are located. 

  • Objects and methods of use: Your personal information will only be processed and used by the Company in electronic or paper form to the extent necessary for the purpose of use and will not be provided to any unrelated third party.

III.  Scope of collection, processing, and use of personal information by this service

In the process of using this service, information may be recorded including but not limited to terminal device and browser data, device location data, IP address, domain name, operation log data, or various types of data that you actively input and upload.
 

The company uses cookie technology to record your habits and preferences in using the service and uses it for the initialization of the relevant service. If you disable cookies in your browser, you will not be able to use the full functionality smoothly.
 

When you contact the company, the company will record your communication/call records and correspondence, contact information, solutions to related problems and results, etc., to contact you or help you solve the problem.
 

The company may conduct data analysis and research on the user information obtained to further provide better services.
 

In accordance with local personal data protection laws, this service does not collect, store, process and use specific personal information, including but not limited to medical records, medical treatment, genetics, sexual life, health examinations, criminal records, politics, religion, beliefs, biometrics and information of minors. Unless this is authorized by you in writing, this may only be done if it does not violate the law.
 

The service will not disclose or share your user information with third parties without your authorization, except in the following circumstances:
      (1)    The law expressly stipulates.
      (2)    To avoid danger to your life, body, freedom, or property.
      (3)    Related to criminal investigation, prosecution, trial, and judgment execution, etc.
      (4)    To protect your life, property and other major legal rights and interests, but it is difficult to obtain your consent.
      (5)    It is necessary for public agencies or academic research institutions to conduct statistical or academic research based on public interests, and the data cannot be identified by the provider or by the collector according to the way in which the data is disclosed.
      (6)    The personal information collected is disclosed to the public by yourself.
      (7)    Personal data collected from lawful public information, such as legitimate news reports, government public information, etc.
      (8)    with your explicit consent.
      (9)    In the event of a merger, acquisition or bankruptcy liquidation of the Company, or other circumstances involving a merger, acquisition, or bankruptcy liquidation, if the transfer of personal information is involved, the Company will require a third party or organization holding your personal information to continue to be bound by this Policy, otherwise the Company will require the company or organization to seek your authorization and consent again.

The Company will sign strict data protection agreements with companies or organizations with which the Company shares personal data, requiring them to process personal data in accordance with this Privacy Policy and any other relevant confidentiality and security measures.
 

When you cancel your use of this service, you can choose to delete or transfer all personal data, and this service will delete or transfer your personal data. Only after you delete data from our company's services, our company may not delete the corresponding data from the backup system immediately but will delete the data when the backup is updated.
 

If the Company ceases to operate the "gMOT Cloud", the Company will immediately stop collecting your personal information, and based on the follow-up service needs, the Company will retain the data for 3 months, that is, delete or de-identify the personal information it holds.

IV.    Data Security
The Company has adopted reasonable and feasible security protection measures that comply with industry standards to protect the security of the personal information you provide and prevent personal information from unauthorized access, public disclosure, use, modification, damage, or loss. For example, the exchange of data between your browser and the server is encrypted and protected by the TLS (Transport Layer Security) protocol; the app on the terminal device is encrypted and encapsulated for protection; the company also provides HTTPS (Hyper Text Transfer Protocol over Secure Socket Layer) secure browsing functionality; the company will use encryption and masking technologies to improve the security of personal data. The company will deploy access control mechanisms to ensure that only authorized personnel can access personal information, while conducting security and privacy protection training courses to enhance employees’ awareness of the importance of protecting personal information.

 

The company attaches great importance to data security and protects your personal information from leakage through corresponding security protection measures. However, please also note that there are no perfect security measures on the data network. In the unfortunate event of a personal information security incident, the Company will notify you within 72 hours by email, letter, telephone, push notification, official website announcement, etc., in accordance with the requirements of laws and regulations.
 

V.    Cross-Border Transfers
With your authorization and consent, our company will comply with local personal data protection laws and transfer personal data collected overseas (such as the European Economic Area) to our cloud platform service providers and partners.

The Company reserves the right to revise this Privacy Policy at any time in response to changes to the Service, or at the opinion of the Customer, or for any other purpose, and the Company will post any changes to the Privacy Policy on a dedicated page (Privacy Policy).
